CivicPlus will administer the solicitation and collection of data and feedback, using the selected method by Customer, including telephone, online, and mail-in options (the “Survey”), from respondents identified by Customer (comprehensively, referred to as the “Services”).
CivicPlus shall use commercially reasonable efforts to ensure the Customer-directed Surveys adhere to all applicable laws and regulations; however, the Customer is responsible for ensuring that all Surveys conducted adhere to applicable laws and regulations, with respect to the respondents contacted and data solicited and collected.
The Customer understands and agrees that all surveys, and constituent outreach programs in general, are susceptible to cybercriminal activities, including without limitation survey spoofing, vishing, phishing, and QR code scams, the Customer is solely responsible for informing their community of these risks and take appropriate precautions to mitigate them.
If the Customer opts to conduct Surveys involving individuals under the age of 13, they must comply with the Children's Online Privacy Protection Act (COPPA). The Customer assumes all responsibilities and risks associated with COPPA compliance.
CivicPlus will collect data as part of the Services, including but not limited to responses from Surveys. CivicPlus will use the collected data to analyze Survey results and community engagement and provide insights into the same to the Customer. Any interpretations provided by CivicPlus are based on its analysis of the Survey data and are intended for informational purposes only. CivicPlus’s analysis does not constitute legal advice, recommendations, or endorsements of any kind. Anonymized and aggregated Survey data may also be used by CivicPlus to improve service offerings. CivicPlus commits to protecting the data collected through industry-standard data security practices, in line with its standard privacy and security policies. The Customer must also ensure that their data collection practices respect the privacy and confidentiality of Survey participants.
The Customer acknowledges and accepts these terms, agreeing that CivicPlus will not be held liable for any consequences arising from the Customer’s use of the Services, Survey responses, or reliance on the information, data, or interpretations provided by CivicPlus.
The Customer understands and agrees that all Surveys shall contain the following transparency statements:
- This Survey is being conducted on behalf of CUSTOMER. The organization conducting the Survey (the “Survey Administrator”) may use the results for purposes such as research, policy development, and other community engagement activities.
- By participating in this Survey, you are providing informed consent to share your data and feedback voluntarily. The Survey Administrator does not endorse or verify the content of this Survey. Any questions or concerns about the Survey should be directed to the Survey Administrator.
- Data Usage and Privacy. All data collected from this Survey will be used solely for the purpose of community engagement and analysis. Your responses will be anonymized and aggregated, ensuring that no personally identifiable information will be shared with any third party unless explicitly noted below.
- Should you voluntarily choose to participate in the resident panel, as explained at the conclusion of this Survey, personal information may be shared with a third party solely as needed for such participation. This Survey will comply with all applicable data protection and privacy laws, ensuring that your information is securely managed throughout the process.
